Scope and Purpose

This Policy aims to regulate the processing of personal data obtained directly or through legal, commercial, or financial relationships with customers, employees, or natural or legal persons that MEDICAL TRAVEL TÜRKİYE interacts with, in accordance with Law No. 6698 on the Protection of Personal Data (KVKK) and the KVKK Policy Book, to determine the conditions that must be adhered to and to declare them.

Disclosure Obligation

Within the scope of Law No. 6698 on the Protection of Personal Data (KVKK), which came into effect on 07.04.2016, MEDICAL TRAVEL TÜRKİYE is required to legally regulate the personal data processed during its relations with customers, employees, and the individuals or legal entities it interacts with, due to the obligations and necessities of the legislation.

MEDICAL TRAVEL TÜRKİYE pays great attention to the principles of personal data security and privacy of customers, employees, and individuals with whom it interacts. During the provision of services, priority is given to the security of the personal data of the relevant individuals.

According to the provisions of the above-mentioned law, all types of personal data that can be associated with a real person (including sensitive personal data) are considered personal data within the scope of the KVKK. These personal data are processed by MEDICAL TRAVEL TÜRKİYE as the Data Controller through the methods explained below and within the limits prescribed by the legislation.

“Processing of Personal Data” means any operation performed on personal data, such as obtaining, recording, storing, retaining, altering, rearranging, disclosing, transferring, taking over, making it retrievable, classifying, or preventing its use, in whole or in part, automatically or through non-automated means, provided that it is part of a data recording system.

Purpose and Legal Basis of Data Processing

Personal data may be collected by MEDICAL TRAVEL TÜRKİYE through automatic or non-automatic methods, such as registration on the platform, phone, fax, email, SMS, other social media channels, mobile applications, including voice and video recordings, in written or verbal form, in electronic or physical environments.

In accordance with Article 5 of the KVKK:

• With the explicit consent of the data subject,
• When explicitly stipulated by laws,
• When it is necessary for the protection of the life or physical integrity of the person who is unable to express their consent due to actual impossibility or whose consent is not legally valid,
• When the processing of personal data belonging to the parties of a contract is necessary, provided that it is directly related to the establishment or performance of a contract,
• When it is necessary for MEDICAL TRAVEL TÜRKİYE to fulfill its legal obligation,
• When the data subject has made their data public,
• When data processing is necessary for the establishment, exercise, or protection of a right,
• When it is necessary for the legitimate interests of MEDICAL TRAVEL TÜRKİYE, provided that it does not harm the fundamental rights and freedoms of the data subject.

• In other cases stipulated by laws

Sharing and Transfer of Personal Data

Personal data of the data subject may be shared with domestic/foreign solution partners, project partners, program and cooperation partners, suppliers, institutions and organizations, independent audit firms, banks, financial institutions, other firms, persons and organizations from which assistance and support are received, lawyers, certified public accountants, legal, IT, quality, and financial consultants, with whom MEDICAL TRAVEL TÜRKİYE has commercial, legal, or economic relationships, when requested by official institutions and organizations as required by the legislation, and to fulfill its responsibilities. Transfer may also occur abroad.

MEDICAL TRAVEL TÜRKİYE may transfer, process, and store the personal data of the data subject to servers, hosting companies, programs, cloud computing, and other electronic environments located in Turkey or abroad, especially in EU countries, the USA, and the UK, provided that necessary security measures are taken.

Method of Collecting Personal Data

Personal data of the data subject may be collected through all agreements/information forms and other documents signed with approval and/or acceptance, electronic approval and/or signatures, MEDICAL TRAVEL TÜRKİYE's administrative center, physical environments, call centers, websites, mobile applications, internet transactions, social media and other public areas, user meetings, scanning of judicial records, market research, Identity Sharing System, SMS, digital applications made to websites, mobile applications, written/digital applications made to sales teams, call center methods, or other methods where contact is made or can be made with the data subject in the future. The data may be collected automatically or non-automatically as part of a data recording system and stored by considering the statute of limitations in accordance with the relevant legislation.

Personal data collected by MEDICAL TRAVEL TÜRKİYE for the above legal reasons may be processed or transferred for the purposes previously explained in this policy, taking into account the conditions for processing personal data specified in Articles 5 and 6 of the Law on the Protection of Personal Data No. 6698.

User Rights

(Under Article 11 of the KVKK)

Data subjects, regarding their personal data, may contact MEDICAL TRAVEL TÜRKİYE through the following email address to:

• Learn whether their data is processed,
• Request information if it has been processed,
• Learn the purpose of processing and whether it is used in line with that purpose,
• Know the third parties to whom data is transferred domestically or abroad,
• Request correction if processed incompletely or inaccurately,
• Request the deletion, destruction, or anonymization of personal data if the reasons for processing no longer exist,
• Request notification of actions taken in accordance with clauses (5) and (6) above to the third parties to whom the data was transferred,
• Object to any unfavorable outcomes resulting from the analysis of data exclusively through automated systems,
• Request compensation for damages incurred due to unlawful processing and other rights specified in the legislation.

Data Controller for Applications Under the Law

MEDICAL TRAVEL TÜRKİYE is registered in the VERBİS system as a Data Controller at www.kvkk.gov.tr.

Data subjects may submit their requests, complaints, or suggestions to the address provided below by personally applying or through a notary, or via the email address recorded on the website during account opening, specifying their name, surname, Turkish ID number, address for notification or workplace address, mobile phone number, email address, and the subject of the request, and including the relevant information and documents related to the request.

All correspondence with MEDICAL TRAVEL TÜRKİYE must be in Turkish as the official language. Therefore, all requests, correspondence, issues, complaints, and suggestions must be written and sent in Turkish.

If the request is submitted in writing and physically, it must be signed with a wet signature.

Responses to requests, issues, suggestions, and complaints are generally free of charge. However, if there is a cost, fee, or other expenses related to the response, MEDICAL TRAVEL TÜRKİYE reserves the right to request fees according to the tariff determined by KVKK Regulations or other authorities.
